The Village of Scarsdale employs professional traffic engineers who monitor traffic conditions and propose traffic safety and regulation programs and processes. The placement and modification of traffic control devices must, in most cases, be approved by the Village Board, which often depends on the Village Manager and a staff Traffic Safety Committee to review issues relating to traffic and parking regulation. Proposals to change traffic regulations can be initiated by the direction of the Village Board, by Village staff or by Village residents. Residents seeking to change a traffic regulation should contact the Village Manager's staff to discuss the nature of the problems and possible options. Neighborhood Associations can be used to formally request a particular action be taken as well. After receipt of a request from a Neighborhood Association which qualifies for Traffic and Safety Committee consideration, engineering staff review of traffic patterns and accident rates, the Police Department is contacted for their opinion, Public Works is involved and a meeting is scheduled by the Traffic and Safety Committee to review staff findings. Staff then makes a recommendation to the Village Manager for implementation or to the Village Board for final action should that be required. Matters addressed through this general process include placement of stop signs at an intersection, parking regulations and signalization of intersections. Typically, residents effected by changes are notified by the Village and notice is printed in the Village's official newspaper.

Pedestrian "Rules of the Road"

Just like motorists, pedestrians are expected to follow certain rules of the road, including:

  • Pedestrians are to use sidewalks whenever they are safely available.
  • When sidewalks are unavailable, pedestrians must walk facing traffic as far to the left as possible.
  • Pedestrians must obey traffic signals and/or traffic officers.
  • At crosswalks where there isn't a traffic control signal or officer, pedestrians have the right-of-way. If there aren't any crosswalks, signs or signals, the pedestrian must yield the right-of-way to all vehicles. Regardless of the right-of-way, the driver is required by law to take great care to avoid hitting pedestrians.

Village Manager's Authority to Adopt Regulations:

The following citations from the Village Code refer to the adoption of many Traffic Regulations by the Village Manager. These regulations include but are not limited to:

The following citation from the Village Code refers to the process the Manager uses for adoption of many Traffic Regulations:

§ 290-4. Adoption of regulations.

A. Regulations in Schedules I, II, III and IV shall be adopted by the Board of Trustees or by an officer or agency authorized by the Board of Trustees to adopt such regulations in accordance with § 1603 of the Vehicle and Traffic Law.

B. Pursuant to § 1603 of the Vehicle and Traffic Law, regulations in Schedules V, VI, VII, VIII, IX, X, XI, XII, XIII, XIV, XV, XVI, XVII, XVIII, XIX, XXX, XXXI, XXXII, XXXIII, XXXIV, XXXV, XXXVI, XXXVII, XXXVIII, XXXIX, XL and XLI shall be designated by the Village Manager in accordance with the requirements of this subsection and the Vehicle and Traffic Law.

(1) All actions by the Village Manager pursuant to this section shall be taken after:

(a) Consideration of the volume and nature of traffic, the needs of the public for parking facilities and public safety and convenience.

(b) Obtaining the views of the Police Department and after consulting with such state, county and village departments and agencies and others as he may deem appropriate.

(c) Publication as " Traffic Rules and Regulations of the Village of Scarsdale" in the official newspaper of the village.

(d) Filing with the Village Clerk on or before publication.

(2) All rules and regulations, or amendments thereto, so published and filed shall become effective not less than 30 days after publication on a date stated therein, unless theretofore vetoed or suspended by resolution of the Board of Trustees, provided that, if the Village Manager determines that an emergency exists, such rules and regulations or any amendment thereof shall become effective on the date specified therein by him.

(3) Any order, rule or regulation or amendment thereof issued by the Village Manager pursuant to this section shall be subject to revocation or suspension by resolution of the Board of Trustees on appeal by an aggrieved party to the Board of Trustees at any meeting thereof held prior to the effective date of any such order, rule or regulation or at any time on motion of the Board of Trustees.

(4) All signs, markings and traffic control devices required by the Vehicle and Traffic Law of the State of New York in connection with parking and traffic controls contained in rules and regulations issued by the Village Manager pursuant to delegations of authority made in this section shall be posted by the Village Manager on or before the effective date of the rules and regulations requiring such signs, markings or traffic control devices. Such signs, markings or traffic control devices shall be maintained by the Village Manager for so long as the rules and regulations requiring them remain in effect.


Village Board's Authority to Adopt Regulations:

The following citation from the Village Code refers to the adoption of many Traffic Regulations by the Village Board of Trustees. These regulations include but are not limited to:

  • § 290-5. Traffic control signals.
  • § 290-6. Speed limits.
    The maximum speed at which vehicles may proceed on or along any streets or highways within the village is hereby established at 30 miles per hour, except that the speed limit for vehicles proceeding on or along those streets or parts of streets described in Schedule II (§ 290-75) shall be as indicated in said schedule.
  • § 290-7. School speed limits.
    No person shall drive a vehicle at a speed in excess of that indicated in Schedule III (§ 290-76), in the areas described in said Schedule III, during school days between the hours of 7:00 a.m. and 6:00 p.m.
  • § 290-8. One-way streets.
    The streets or parts of streets described in Schedule IV (§ 290-77), attached to and made a part of this chapter, are hereby designated as on-way streets in the direction indicated.
